Accused murderer is ordered detained

Accused killer Allan Shyback, who is alleged to have murdered his common-law wife, has been ordered detained.

But one of Shyback’s lawyers said Friday the defence will appeal the ruling to keep their client behind bars pending an unscheduled trial.

“We’re going to appeal it,” said defence counsel Jillian Williamson, who along with Balfour Der, acts for Shyback.

Williamson said the defence will have to prepare materials before applying to the Court of Appeal to reconsider the decision by Court of Queen’s Bench Justice Bruce Millar.

A date for Millar’s decision on Shyback’s bail application was to be set Friday.

But Williamson said they received a written ruling last week in which Millar ordered the murder suspect detained pending trial.

Shyback was also in court to set a trial date, but law student Alin Mayer asked that the decision be postponed until April 29.

Shyback is charged with second-degree murder and committing an indignity to a body in connection with the October, 2012, disappearance and death of his common-law wife, Lisa Mitchell.

He was committed to stand trial last month following a preliminary inquiry.

Shyback was arrested in December, 2014, and charged with murder in connection with the death of Mitchell.

At that time he was also charged with committing an indignity to a body after remains were found in the southeast duplex once shared by the couple.

Police forensics teams descended upon a home in the 7600 block of 26A St. S.E. on Dec. 5, 2014, spending the night removing evidence and other items from the two-storey duplex.

Shyback and Mitchell’s two children — one of whom was his — had been living in the home during the time their mother had disappeared.

Police would not comment specifically at the time on how the accused and two children could live in the same house with human remains, but said there were “circumstances within the house” that will be revealed in court.
